US Judge Mandates Release of Kilmar Abrego Garcia from ICE Custody
A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without legal authority.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her order.
The case originates in a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an error. After his return to the United States to answer human smuggling allegations, he was detained in federal detention.
In her order, the judge noted that the authorities does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."
